PGAPPS APPLICATION TERM & CONDITIONS

Thank you for using this PGApps Application. The following terms and conditions govern your use of this application, including any service or content we provide you via the application (together, the Online Services, Terms of Use), therefore please read them carefully. The Online Services allow you to find out information about this application, products and services, promotions and competitions, and certain services which may be provided by PGApps Application to you.

The PGApps Application is owned and operated by PT Fantastis Anak Bangsa Indonesia (hereinafter referred to as “we, our, us”). While every endeavour has been made to supply accurate information, errors and omissions may occur. Accordingly, we do not accept any liability for any loss or damage which may directly or indirectly result from any advice, opinion, information, representation or omission, whether negligent or otherwise, contained on or accessed through the Online Services. Any material that you see on the Online Services may be protected by copyright, trade mark, patent or other protections, even if it is not stated to be. The Online Services are intended for use by people located in Indonesia and are not intended for use by people located outside Indonesia. We may need to obtain personal information from you in the course of providing the Online Services to you. Personal information is any information about you that identifies you, or by which your identity can reasonably be ascertained. Our Privacy Policy, which is located here, sets out how we can collect, hold and use your personal information. This Privacy Policy also forms part of these terms and conditions. We also can change these terms and conditions at any time, without notice to you by updating them on the Site. The revised terms will take effect when they are posted and your continued use of the Online Services means you agree to our revised terms. The Online Services are governed by Indonesian law. If we have any issues which need to be resolved by a court, you agree to the exclusive jurisdiction of Indonesian courts.

A. GENERAL TERM

  1. PGApps Application is a technology-based information media, supported by websites and applications for Android and IOS. PGApps Application can be a new platform for providing information and maps based on user input. It also allows Indonesian travellers to discover and explore Indonesia and beyond and in more convenient, fun and enriching way (“ PGApps ”).
  2. The PGApps is launched during this pandemic in order to find and explore new places and areas/areas affected by Covid-19, so can help the tourism industry and beyond, as it provides assurance and confidence for Indonesian travellers to travel around Indonesia again, again and again.
  3. The PGApps works to meet the needs of individuals, communities and companies to disseminate information that is either an activity they create or want to find, such as tourist attractions that will visit whether the place is sufficient to follow health protocols or not, areas that are densely populated and not. The PGApps collaborates with Google Maps to make it easier for service users to find out which location to go to for event creation and the location that they want to visit in person and integrated.
  4. The information provided by the PGApps comes from other PGApps users. The information may be incomplete and accurate or even late. The PGApps does not provide any guarantee as to the credibility of this information.
  5. Some features in the PGApps use detailed location and route information, which is contained in the form of GPS signals and other information (such as photos) sent by the mobile device where the PGApps is installed and activated. So that these features cannot be provided and enjoyed if the mobile device does not support this technology.
  6. An internet connection (Wi-fi, 3G, 4G, 5G) is required to be able to use this PGApps (including but not limited to sending and receiving updates in the PGApps) and all related costs (cellular data) incurred as a result of using the PGApps is the sole responsibility of the user. The cost of downloading and accessing the PGApps service is a data fee determined by each telecommunication service provider.
  7. The PGApps can be used by users to upload photos from places that users can provide comments and/or ratings about that place.
  8. By becoming the PGApps user, the user is deemed to have understood and agreed to all contents in the terms and conditions of use of the PGApps, user manuals, and other provisions published by the PGApps.

B. USER MEMBERSHIP

By registering for and/or using the Services in any manner, including but not limited to visiting or browsing the application, where applicable, you agree to all of the terms and conditions contained herein. If you do not agree to these terms, you should cease using the Online Services.

User Registration :

  1. The PGApps can be used for all ages.
  2. Users are required to have an email account as authentication when connecting to the PGApps server. This will result in your email address being allocated as a username that must be used whenever requested and a personal account being created. That username is personal to you and is the means by which you will access the Online Services and your account.
  3. Users are required to enter the correct phone number so that it is easy for us to verify the data if one day the user uses the facility to create activities through the PGApps.
  4. Each user is only allowed to have 1 (one) ID.
  5. If the ID used is not in accordance with the provisions above, the PGApps will cancel and delete the ID after receiving notification.

User Obligations :

  1. Fulfill the provisions of the laws and regulations in force in the Republic of Indonesia or each country in accordance with their respective nationalities and the policies that apply in the PGApps.
  2. Each user is responsible for the information distributed and other activities in the PGApps.
  3. Any abuse of access rights by other parties is the responsibility of the user.
  4. Users are required to maintain confidentiality and prevent misuse of accounts and data and information that are not intended for the general public.
  5. Users agree that all information you make available to us when registering or using the Online Services is true, accurate, up to date, complete and not false, misleading or deceptive in any material way.

To the maximum extent permitted by law, we will not be liable, whether in contract, tort or otherwise, for any loss, damage or injury arising directly or indirectly from any use of the Online Services or your account, or any third party gaining unauthorised access to your personal information.

User Terms :

  1. The user agrees that using PGApps may not violate the laws and regulations in force in the Republic of Indonesia or each country according to the user's nationality.
  2. The user agrees that attempts to manipulate data, disrupt the PGApps system and network are against the law.
  3. The user agrees that PGApps will access their device's camera to capture video & photo to be shown to public as feed & report.
  4. The user agrees that PGApps will access user's device storage when uploading the report using video / images.
  5. The user agrees that PGApps will access to user's device cookie for analytics purpose.
  6. The user agrees that PGApps will collect data from their GPS position as long as the application is running
  7. Users are prohibited from making hate speech or providing SARA information, information that is incorrect.
  8. The user agrees that third party advertisements may appear within PGApps from time to time.
  9. Users can stop using the PGApps at any time and for any reason. The user is not obliged to notify the PGApps application regarding the planned outage. However, if the user also wants the PGApps application to delete the PGApps ID and the information contained in that ID, then the user can use the "Delete account" feature in the settings menu in the PGApps. The PGApps will make reasonable efforts to delete such information, however, please note that such information may not be removed immediately from our backup systems.
  10. Users must not disrupt or interfere with the Online Services or servers or other software, hardware or equipment connected to or via the PGApps. You must not break any relevant law which applies to the use of the Online Services. If you do any of these things or otherwise use the Online Services inappropriately or maliciously you will indemnify us for any loss we suffer in connection with what you have done.

User Cancellation and Blocking :

  1. PGApps has the right to suspend / temporarily block / cancel user access rights if it is found that there is information / activity that is not justified for any reason that PGApps deems appropriate, at its sole discretion and the decision is absolute.
  2. The user is allowed / has the right to delete the PGApps application on the user's device.

C. RESPONSIBILITY AND LIMITATION OF LIABILITY

  1. PGApps is not responsible for all consequences that occur due to legal violations committed by users and other parties.
  2. PGApps is not responsible for any consequences of misuse of the PGApps application by users or other parties.
  3. PGApps will use reasonable endeavours to keep the application free from viruses and from unauthorised access. However PGApps does not guarantee that PGApps always operate uninterrupted or error-free or that any files available for downloading by you will be error-free or free from viruses, faults or defects.
  4. PGApps strives to continue to innovate, improve and improve the performance of the PGApps application.
  5. PGApps can help PGApps application users related to resolving usage errors or resolving limitations of application facilities / features, but is not responsible for the results resulting from their actions.
  6. PGApps can take an action that is deemed necessary against the user in the event that the user violates the law in using the PGApps application.
  7. Users bear all consequences for uploaded content made using the PGApps application.
  8. PGApps is not responsible for the loss of user data, either directly or indirectly, and demands from any party for the interruption of PGApps's services. If this happens, the user will not blame PGApps in any form.
  9. PGApps has the right to delete content uploaded by users if it violates the rules and regulations of the Republic of Indonesia law.
  10. PGApps will endeavour to keep information on the Online Services as accurate and up to date as possible. However, the Online Services may have some material which is not accurate or up to date in all respects or errors or omissions may occur. For this reason, we do not warrant the accuracy or completeness of the information and, to the extent we are able to by law, we do not accept any liability for any errors on the Online Services.
  11. PGApps may update information on the Online Services at any time and without notice
  12. We disclaim (to the maximum extent permitted in law) all liability for any damage or loss or any compensation resulting from your use of, or reliance on, the Online Services or the information provided via the Online Services, including but not limited to the damage to the user's device system which is caused by the use of our services or applications (such as disconnection from the uplink / ISP / provider internet, hardware damage, user error, accidental negligence of PGApps, etc.)

D. CONTENT

All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. PGApps cannot guarantee the authenticity of any Content or data which users may provide about themselves. You acknowledge that all Content accessed by you using the Service is at your own risk and you will be solely responsible and liable for any damage or loss to you or any other party resulting therefrom. For purposes of these Terms of Use, the term "Content" includes, without limitation, any location information, "shouts", videos, audio clips, comments, information, data, text, photographs, software, scripts, graphics, and interactive features generated, provided, or otherwise you make accessible to PGApps on or through the Services. Content you add, create, upload, submit, distribute, post or otherwise obtain through your use of the Services, including Content that you add to the Services if you link your accounts to third party websites and services, is collectively referred to as, "User Submissions."

E. COPYRIGHT

  1. We may use your User Submissions in a number of ways in connection with our Services and business as PGApps may determine in its sole discretion, including but not limited to, publicly displaying it, reformatting it, incorporating it into marketing materials, advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing other users to do the same in connection with their own websites, media platforms, and applications (“Third Party Media”). By submitting User Submissions on our application or otherwise through the Services, you hereby grant PGApps a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to host, use, store, copy, edit, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Submissions and any content that your submit to PGApps for business purposes (e.g. promoting the Sweepstakes in which you participated) in connection with our Services and PGApps's (and its successors and assigns') businesses, including without limitation for promoting and redistributing part or all of the Sites (and derivative works thereof) or the Services in any media formats and through any media channels (including, without limitation, third party websites and feeds). You also grant each user of our Sites and/or the Services, including Third Party Media, a non-exclusive license to access your User Submissions through our Sites and the Services, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and perform such User Submissions in connection with their use of our Sites, Services and Third Party Media. For clarity, the foregoing license grant to PGApps does not affect your other ownership or license rights in your User Submission(s), including the right to grant additional licenses to the material in your User Submission(s), unless otherwise agreed in writing with PGApps.
  2. You represent and warrant that you have all rights to grant such license to us without infringement or violation of any third-party rights, including without limitation, any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights.
  3. You understand that all information publicly posted or privately transmitted through our Sites is the sole responsibility of the person from which such Content originated; that PGApps will not be liable for any errors or omissions in any Content; and that PGApps cannot guarantee the identity of any other users with whom you may interact in the course of using our Services.
  4. When you delete your User Submissions, they will be removed from the Services. However, you understand that any removed User Submissions may persist in backup copies for a reasonable period of time (but following removal, it will not be shared with others) or may remain with users or third parties who have previously accessed or downloaded your User Submissions.
  5. PGApps does not guarantee that any Content or User Submission (as defined above) will be made available through the Service. PGApps has no obligation to monitor the Services, Content, or User Submissions. However, PGApps reserves the right to (i) remove, suspend, edit or modify any Content in its sole discretion, including without limitation any User Submissions at any time, without notice to you and for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if PGApps is concerned that you may have violated these Terms of Use), or for no reason at all and (ii) to remove, suspend or block any User Submissions from the Service. PGApps also reserves the right to access, read, preserve, and disclose any information as PGApps reasonably believes is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms of Use, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of PGApps, its users and the public.

F. MODIFICATION

  1. PGApps has the right/can add, subtract, improve the rules and conditions of this PGApps application at any time, with or without prior notification to the user.
  2. PGApps has the right / can add, subtract, improve the facilities / features provided by the PGApps application at any time, with or without prior notification to the user.
  3. Users are required to obey the rules and regulations that have been added, subtracted, corrected. If the user does not agree, he can submit an objection and resign by deleting the PGApps application from the user's device.
  4. With or without reason, PGApps has the right to stop using the PGApps application and access to this service without bearing any liability to the user if this operational termination is forced to do so.

G. PRIVACY POLICY

PGApps is committed to protecting your privacy. We have robust systems in place to provide you with services and information tailored to your individual needs. The Services are intended for use by people located in Indonesia and are not intended for use by anyone located outside of Indonesia.

We may change this Privacy Policy from time to time and we will tell you about a change in the Privacy Policy by updating the “last updated” date on our website. Unless otherwise stated, any changes to the Privacy Policy will take effect immediately upon being placed on the website and your continued use of the Services will represent an agreement by you to be bound the Privacy Policy as amended.
